The Connecticut Appellate Court in the matter of Tsitaridis vs. Tsitaridis found that the Connecticut Superior Court failed to use the proper standard pursuant to Connecticut General Statutes Section 52-212 in deciding whether to open and vacate a default judgment. The Connecticut Appellate Court found that the lower court should have made factual findings and determined whether the defendant presented sufficient evidence to show reasonable cause and whether she was hindered in prosecuting this dissolution of marriage action as a result of mistake, accident or other reasonable cause.
