Third Party's Claim to Child Denied

In February of 2007, in Rodriguez vs. Rodriguez, FA-05-4015234-S, the Court (Solomon, J.) denied a third party's claim to a child. The Court enunciated the three (3) remedies available to third parties in Connecticut with respect to minor children. First, one may commence a visitation application pursuant to Connecticut General Statutes Section 46b-59. Second, if neglect, abuse or danger can be substantiated, an action may be commenced pursuant to Connecticut General Statutes Section 46b-129 in juvenile court. Third, so long as one can meet the statutory criteria, one may commence an action pursuant to Connecticut General Statutes Section 45a-614 in probate court. Connecticut Superior Court Improperly Denies Wife's Motion to Open Dissolution Judgment

The Connecticut Appellate Court in the matter of Tsitaridis vs. Tsitaridis found that the Connecticut Superior Court failed to use the proper standard pursuant to Connecticut General Statutes Section 52-212 in deciding whether to open and vacate a default judgment. The Connecticut Appellate Court found that the lower court should have made factual findings and determined whether the defendant presented sufficient evidence to show reasonable cause and whether she was hindered in prosecuting this dissolution of marriage action as a result of mistake, accident or other reasonable cause. In Detroit, Judge Bill Callahan has been praised by the Dads and Moms
of Michigan organization. He states that it is important for the health and social well being of children to have both parents involved in the upbringing of children.
